Nature of this document
This contract governs the manufacture of custom-made panels on plateart.es. It is expressly accepted upon confirming the order and approving the design preview, at which point the panel enters manufacturing and the right of withdrawal is lost in accordance with article 103.a of Royal Legislative Decree 1/2007 (TRLGDCU).

Customer
The natural or legal person identified in the order and the corresponding billing data. Acceptance of this contract binds the person listed as the order holder.
Subject matter
The customer commissions the seller to manufacture one or more composite aluminium wall panels, personalised with:
- A motif from the PlateART catalogue, in the dimensions, materials and finishes that the customer chooses in the configurator, or
- An image provided by the customer (“uploaded image”), reproduced on the panel with the dimensions, materials and finishes chosen.
The exact details (reference, dimensions in centimetres, material, finish, motif, uploaded image) are stated in the order summary and in the preview that the customer approves before manufacturing.
Customer warranties regarding the uploaded image
When the customer uploads their own image to personalise the panel, they expressly declare and warrant that:
- They hold the rights of intellectual and industrial property over the image, or have sufficient authorisation from the rights holder to reproduce it for manufacturing and private use of the panel.
- The image does not contain personal data of third parties without their consent, trademarks or characters protected by third parties without licence, nor illegal, defamatory, violent, sexually explicit, racist content or content infringing applicable law.
- It does not infringe the right to honour, privacy and the customer’s own image of third parties (Spanish Organic Law 1/1982).
- They are of legal age or have parental or tutorial authorisation when the image contains minors.
Limited assignment of rights to PlateART
The customer grants Fliesencenter S.L.U. a non-exclusive, free licence, limited in time and purpose, exclusively to:
- Receive, store and process the image.
- Reproduce, crop, technically adjust and prepare it for digital printing on composite aluminium.
- Retain it for the period necessary to manufacture, deliver and provide the statutory warranty of the product.
Fliesencenter S.L.U. will not use the image for any other purpose (advertising, social media, catalogue, third parties) without the customer’s additional, express and separate consent. Once the retention periods expire, the image is deleted in accordance with the privacy policy.
Indemnity
The customer expressly indemnifies Fliesencenter S.L.U. against any claim, sanction or compensation arising from the use or reproduction of the uploaded image when it is shown that the customer was not the rights holder or did not have sufficient authorisation. In such case, they will assume against Fliesencenter S.L.U. and against third parties the damages and costs that the claim causes, including legal defence costs.
Visual preview and approval
Before manufacturing, PlateART sends the customer a free visual preview (rendering or scaled composition) that reflects the expected panel result. The customer has the reasonable period indicated in the preview email to:
- Approve the preview (“I give my OK”) → manufacturing is authorised.
- Request changes on dimensions, framing or details of the motif.
- Cancel the order at no cost, with full refund within a maximum of 14 days.
Loss of the right of withdrawal
Pursuant to article 103.a of Royal Legislative Decree 1/2007 (TRLGDCU), upon approving the preview the customer expressly declares that they lose the 14-day right of withdrawal provided for distance purchases, as it concerns goods made to their specifications and clearly personalised.
From that moment:
- The panel enters the manufacturing queue.
- It is not possible to cancel the order or return it for simple change of mind.
- The customer’s rights against defective product, damaged in transit or non-compliant with the approved preview are fully preserved (see below).
Lead times
- Preview: up to 48 working hours from order confirmation.
- Manufacturing and shipping (after preview approval): 10–14 working days to mainland Spain; other destinations according to the shipping policy.
Any significant deviation due to force majeure (stock shortage, logistics incident, holidays) is communicated to the customer as soon as possible with the new estimated date.
Product warranty
- Statutory warranty of conformity: 3 years from delivery (Law 7/2021, arts. 117 and following TRLGDCU).
- Commercial manufacturer warranty: 5 years on finish durability under normal use conditions, granted by PlateART.
The warranty covers material and manufacturing defects. It does not cover damage from incorrect installation, subsequent impacts, exposure to aggressive chemicals or normal aesthetic wear.
If the panel arrives defective, damaged or non-compliant with the approved preview, the customer must notify by email at info@plateart.es or by WhatsApp (https://wa.me/34965843059) as soon as they detect it, ideally with photographs of the product and packaging. PlateART will offer replacement, repair or refund as appropriate to the statutory warranty.
Processing of personal data
The processing of the customer’s personal data (identification, contact, billing, shipping, uploaded image) is governed by Fliesencenter S.L.U.’s privacy policy. The legal bases are the performance of the contract (art. 6.1.b GDPR) and compliance with legal obligations (art. 6.1.c GDPR).
The customer may exercise at any time the rights of access, rectification, erasure, objection, portability and restriction by writing to info@plateart.es (see Exercise of your rights).
Audited acceptance
Acceptance of this contract is recorded electronically and is associated with the order. Fliesencenter S.L.U. retains as evidence:
- Date and time of acceptance (timestamp).
- IP address from which it was made.
- Browser identifier (user agent).
- Unique identifier of the order and the customer.
- SHA-256 hash of the full text of the accepted contract.
This data is retained for the legal prescription period of actions arising from the contract and is provided, where appropriate, as evidence in case of claims or legal requirements. The customer receives a copy of the signed contract in PDF format in the order confirmation email and can download it at any time from their account.
Dispute resolution
Disputes are governed by Spanish law. In accordance with Regulation (EU) 524/2013, the European online dispute resolution platform is hereby reported: https://ec.europa.eu/consumers/odr/. For any judicial proceeding, the parties submit to the courts of Alicante (España), without prejudice to the mandatory jurisdiction of the consumer’s domicile.
